Terms of Service
These terms govern use of the Johnny's Backyard website and purchases made through it. By using the site or placing an order, you agree to these terms and the policies linked from the site.
Product purchases
Prices, descriptions, images, dimensions, availability, and estimated timing may change, and reasonable variations may occur. Unless the order expressly says otherwise, a product price covers the identified product only; taxes, delivery, shipping, site work, installation, permits, and other services are separate. We may correct errors, reject or cancel an order, or contact you for approval before proceeding when pricing, inventory, configuration, or fulfillment information is inaccurate.
Payment and order acceptance
You represent that you are authorized to use the payment method and that the order information is accurate. An order acknowledgment is not final acceptance. Acceptance occurs when we confirm the order or begin fulfillment. Deposits and financing are subject to the written terms presented for the applicable order or provider.
Customer responsibilities
Unless expressly included in writing, the customer is responsible for confirming measurements, safe access and placement, underground and overhead utilities, property boundaries, HOA approval, permits, required clearances, and site preparation. Adult supervision and compliance with manufacturer safety and maintenance instructions are required after delivery or installation.
Delivery, installation, returns, and warranties
Our Shipping and Delivery and Returns and Cancellations policies are incorporated into these terms. Manufacturer warranties apply according to their written terms. Except for an express written warranty or a right that cannot be excluded by law, products and services are provided as available without additional implied promises.
Acceptable site use
You may use the site only for lawful personal or business shopping and communication. You may not interfere with the site, misuse accounts, introduce malicious code, scrape or copy protected content at scale, impersonate another person, or use Johnny's Backyard names, images, or trademarks without permission.
Limits and governing law
To the fullest extent permitted by law, Johnny's Backyard is not liable for indirect, incidental, special, or consequential damages arising from the site or an order. Our total liability for a claim will not exceed the amount paid for the product or service giving rise to that claim. Texas law governs these terms, without regard to conflict-of-law rules. Nothing here limits a consumer right that cannot legally be waived.
Changes and contact
